GSM PORTAL PRIVACY POLICY

We at OGSystems, LLC, along with our subsidiaries and affiliates (“OGSystems”), respect your concerns about privacy. This Privacy Policy, which applies to OGSystems’ GEOINT Solutions Marketplace (GSM) website and any associated websites (collectively, the “Portal”), describes the types of personal information we collect on the Portal, how we use the information, with whom we share it and the choices available to you regarding our use of the information. We also describe the measures we take to protect the security of the information and how you can contact us about our privacy practices.

Information We Collect

OGSystems provides content access, management and hosting services in connection with the operation of the Portal and the facilitation of communication between Users on the Portal, including, but not limited to, information, products, services and listings provided by Users and third parties and collaboration features used to support discussions between Users in an open forum (collectively, the “Services”). In connection with these Services, OGSystems may request and store information about organizations, products, mission challenges and individuals. All information that you input when accessing and/or using the Portal is subject to collection and storage by OGSystems.

We may collect and store any personal information that you provide when you use the Portal, such as when you create a user account and choose a password, access the Portal or request information, participate in discussions or communicate with other users through the Portal, post information of any kind on the Portal (such as products, challenges, background information or registration information), or contact us through the Portal. This information can include, but is not limited to, (a) your name, email address, postal or other physical address, or other contact information; (b) username, password and other registration information; (c) title, occupation and any other information used to carry out a transaction you have requested; and (d) information you provide us when you contact us. You may provide personal information directly or it may be gleaned through the Portal. For example, when you create a user account and choose a password for security, you are required to provide personal information. The Portal saves your information so that the next time you access your account, you only need to enter your unique ID and password. Personal information also will be shared by users in connection with communications made through the Portal. If you contact us, a record of that session or correspondence will be maintained. We may retain these communications in order to process your inquiries, respond to your requests and improve the Portal and/or the Services. Your contact information is collected and stored when you access the Portal or request information.

We also may automatically collect information regarding your interaction with, and use of, the Portal. OGSystems may use a variety of methods to collect this information, including, but not limited to, cookies, pixel tags, Web beacons, embedded Web links and other commonly used information gathering tools. Through these automated collection methods, we may collect information that your browser or device sends to us, such as your browser type and language, access times, IP address, user-agent string, unique device identifier, browser characteristics (such as browser type and language) and click stream behavior. We also may use Google Analytics or similar analytics services on the Portal to help us analyze how visitors use the Portal. Information may be collected by us or by our service providers. We may combine information you provide to us with other information from other OGSystems’ sources, transactions and communications. We also may combine that information with data that is publicly available and data from third parties.

How We Use The Information We Collect

We may use the information described above to:

Enable Your Use of the Portal: We use your information in order to allow users to (a) access the Portal community resources such as forums, wiki and the issue tracker, (b) identify information to track web site activity and asset downloads, (c) target promotional emails based on the provided preferences, and (d) associate forum comments, blog posts and wiki contributions to the specific user.

Operate, Improve and Analyze: We may use your information to operate, provide, improve and maintain the Portal and the Services, including (a) analyzing user behavior and trends, (b) sending you administrative messages and other information about the Portal, (c) complying with and enforcing applicable legal requirements, relevant industry standards, contractual obligations and our policies, including our Terms of Use, (d) maintaining the integrity of the OGSystems’ network and addressing any other security issues, and (e) protecting against, identify and prevent fraud and other unlawful activity, claims and other liabilities.

Marketing and Promotion: We may use your information to communicate with you about the Portal and other products and services, administer surveys or other features and display relevant marketing to you.

Information collected from any source may be combined to improve the Portal and the Service, and enable more targeted, tailored communications. It also may be aggregated and made available without identifying you to ascertain trends, products, security/privacy patterns and research, internal record keeping and reporting, measuring and reporting learning, performance and other statistical information concerning any aspect of the Services and the Portal.

With Whom Do We Share the Information We Receive?

We do not sell or disclose personal information we obtain about you through the Portal, except as described in this Privacy Policy. We may provide your information to our current or future subsidiaries and affiliates (the “OGSystems Group”). Unless prohibited by applicable law, all companies within the OGSystems Group share information collected through the Portal and may contact you directly. We also may share your information with the individual or entity that established the community in which you are a member.

We share personal information with third-party companies (including our affiliates) and individuals who perform services on our behalf. For example, we work with support companies who assist with the administration of the Portal, including, but not limited to, hosting the Portal on their servers and assisting with your questions and technical issues. These third parties are not authorized by us to use or disclose the information except as necessary to perform services on our behalf or comply with legal requirements.

We also may disclose information about you (i) if we are required to do so by law or legal process, (ii) to law enforcement authorities or other government entities based on a lawful disclosure request, or (iii) when we believe disclosure is necessary or appropriate to prevent harm or financial loss, or in connection with an investigation of suspected or actual fraudulent or illegal activity. We reserve the right to transfer personal information we have about you in the event we sell or transfer all or a portion of our business or assets (including in the event of a reorganization, spin-off, dissolution or liquidation).

Information Shared by Users

The Portal may contain message boards, forums, bulletin boards and other interactive features that allow users to post, comment, submit, publish, display or transmit to other Users or third parties content or materials (collectively, “User Contributions”) on or through the Portal. We do not treat such User Contributions as private. User Contributions are subject to the terms of this Privacy Policy. User Contributions may be gathered, used and shared by us in accordance with the terms of this Privacy Policy.

Notice to California Residents

Subject to certain limitations under California Civil Code § 1798.83, California residents may ask us to provide them with (i) a list of certain categories of personal information that we have disclosed to third parties for their direct marketing purposes during the immediately preceding calendar year, and (ii) the identity of those third parties. To make this request, California residents may contact us as specified in the Contact Us section below.

Data Retention

We may collect and store your data for as long as you continue to access the Portal and/or use the Services. Please note that after you cease to access the Portal, your data is not automatically deleted and will continue to exist, with all information associated with your account being subject to use, sharing and retention as stated in this Privacy Policy.

Information Security

We maintain administrative, technical and physical safeguards designed to protect the personal information we obtain through the Portal against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use.

Third-Party Links

The Portal contains links to other Internet websites or resources, some of which are essential to provide the full measure of the Services. When you link to those sites, you leave the Portal. We have no control over such sites, their content and resources, or the business practices or policies of operators of such sites. The terms set forth in this Privacy Policy and the Terms of Use do not apply to the practices of any companies or individuals operating the linked sites. Please use caution and review the privacy policies of any sites that you visit to learn more about their information-gathering practices. We expressly disclaim all responsibility or liability for the availability or accuracy of such external sites or resources or the content thereon, does not endorse and is not responsible or liable for any advertising, products, materials or services available from such sites or resources and/or any claims, representations or warranties made by third parties with respect to their goods or services. The inclusion of any link on the Portal does not imply that OGSystems endorses the linked site. Your use of any links is at your own risk. You further acknowledge and agree that OGSystems shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with your use of or reliance on any goods, services or materials available on or through any such link, site or resource.

Access by Children

We do not target or market to children at all, but especially those under age sixteen (16). We do not knowingly and will not intentionally contact or request personal information from children under the age of sixteen (16) for any purpose. We will not knowingly contact children under age sixteen (16) without a parent’s permission, nor will it ask for more personal information than is reasonably necessary to participate in a given activity. If we obtain actual knowledge that a child under sixteen (16) has submitted his or her personal information, it will attempt to delete the information as soon as possible or seek parental consent. The Portal does not filter ads or other material children may view through the Portal or linked sites, some of which may be inappropriate for children.

Modifications to this Privacy Policy

We may modify this Privacy Policy without prior notice. We will post a notice to the Portal if we change this Privacy Policy. You also should regularly review this Privacy Policy. We may ask you to affirmatively acknowledge consent to any changes to this Privacy Policy (e.g., by checking a box or clicking a button) at the time of your next interaction with the Portal that requires provision of Personal Information as a condition of continuing use of the Portal. You agree that we shall not be liable to you or to any third party in any way for any modifications to this Privacy Policy.
